Just got a letter through asking me to confirm if I was driving at the time of that accident and that they are considering the charge of “Driving without due care and consideration”.
Cant believe it, I didn’t do anything wrong but am bloody bricking it now. They clearly think I have or they wouldn’t have sent the letter. Half think I should ring them and try and find out what happening and explain myself. But then maybe I should just fill out the form and if they want to interview me I suppose I get access to a solicitor?
Dont spose anyones got any advice? This is the bloody last thing I need right now.
Think I will ring tomorrow and try find out what the hells going on
December 18, 2009 at 3:50 pm #1221218OK SO THEY MUST OF SAID SUSPITION OF DRIVING WITHOUT DUE CARE REALLY DONT PANIC ALL THAT IS IS THE GUY HAS TRIED TO PASS THE BLAME BUT WITHOUT EVIDENCE THEY CANNOT CHARGE YOU OF ANYTHINK IM GUESSING POLICE CAME AFTER YOU WENT AND THE GUY FOBBED THEM A STORY NOW WHEN YOU GO I DO RECOMEND A SOLICITOR ANY TIME YOU TALK OFFICIAL WITH THE OB BUT JUST GIVE YOUR SIDE ETC SAY NOTHINK HAPPENED ON YOUR BEHALF ETC THE GUY WAS WELL AGGRESIVE SO YOU GOT WORRIED AND HEADED HOME BUT ON NO PART ADMIT ANY BLAME FOR IT . AND REMEMBER THE POLICE ARE NOT YOUR FRIEND SO THEY WILL TRY SOFTEN YOU UP TO MAKE YOU SAY THINGS THEY WOULDLIKE TO HEAR HOPE THIS HELPS AND IF THERE WAS CCTV OR ANY WITNESSES LIKE WORKERS ETCYOU COULD RECALL THIS WILL HELP YOU

If TVP had any real evidence they’d send the “Tango Victors” to your address or wherever the car is registered to nick you there and then. Either the road rage motorists solicitor has launched a counterclaim, or TVP are more interested in you as a witness than a suspect…

thanks man good advice. I guess the issue is weather I ring them tomorrow to find out what’s going on, and I guess if they do they will ask me to explain my actions/what happend. or just send off the form and see if they ring me/ask me to come in for an interview.

so you don’t think they will charge me its more of a get my side of the story type thing?
If it were you would you ring them up and explain what happened or just send off the form and see what they do?
December 18, 2009 at 4:13 pm #1221219if i got the letteri would go to the station and give a written statement explaining what you saw but also go to ask why they want you first i.e as a witness or a suspect like gl said
December 18, 2009 at 4:14 pm #1221212I’d find a solicitor who specialises in traffic law and then call the cops on their normal number to ascertain what they want. It is highly unlikely TVP will attempt to charge you unless you are known for other traffic offences or anything else they want you for.

not 100% here but im pretty sure you can just get legal aid (free solicitor)when your at the station . and any witness you can get to help your case is a real bonus but anyhow without evidence they shouldnt be able to do nothink not that you did any think in the first place

I presume that if they interview me under caution then I am entitled to legal aid. I will have a think over the weekend and try and decide if I should ring them or wait and see if they contact me.

and that will also be on 1984’s NHS record which the criminal justice system can obtain access to in some circumstances…

yeah I do, I think not stopping was totally responsible as I was worried about his aggression and I wasn’t directly involved anyway he was just overtaking me at the time.

December 18, 2009 at 5:24 pm #1221221yeah you could or i think you can even just phone them just relax a little but dont put the police off for to long at the end of the day you were driving fine you never broke anylaw so just let them run there inquiry and you should be fine im sure they will have a statement from not just the aggresive guy but the other party involved which should sup[port the fact that he was overtaking you
December 18, 2009 at 5:31 pm #1221226if you look at the situation without drawing potential conclusions – you are a citizen with no history of voilence etc, you suffer from anxiety. along comes a speeding aggressive man, i think you have quite a right in terms of a moral viewpoint to get the fuck out of there :0
just think before you speak if you are questioned 🙂 theres no “Speed completion bonus”
